First up: birthright citizenship. On the first day of his second term in office, President Donald Trump issued an executive order saying birthright citizenship does not apply to the children of undocumented immigrants, arguing they are not “subject to the jurisdiction” of the United States. In making its case, the administration has revived arguments from 1898 made in United States v. Wong Kim Ark. A descendant of Wong Kim Ark reflects on the threat to his family’s legacy, and then University of New Hampshire history professor Lucy Salyer analyzes why the administration is relying on a century-old argument to make its case today.
