District Judge Kelly that granted CNN, MS NOW, Politico, and three reporters a temporary restraining order restoring their deactivated White House hard passes after President Trump announced that he was immediately banning those organizations. The court incorrectly treated White House press passes as a constitutional “liberty interest” protected by Fifth Amendment due process rights, requiring notice, hearings, and formal standards before passes could be revoked. These rights are not found in the Constitution; access to the White House is not a constitutional freedom, and the executive branch should have broad authority to determine who receives access, particularly when national security concerns are cited.
