## Resource

A Douglas County judge just threw out a felony case against Elijah Joseph Garcia, dropping charges of aggravated battery and cocaine possession because police unlawfully detained him two years ago — and all evidence was tossed out as “fruits of the poisonous tree.” The arrest began when officers asked to see his hands in a parking lot; though he complied, the judge ruled the stop violated his constitutional rights since officers lacked sufficient suspicion to detain him. Later, an unreliable ID compounded the issues. This dismissal follows Garcia’s recent acquittal in another assault case — a powerful reminder that police must follow procedure or risk losing everything.
